Total loss of vehicle, do I still have to pay the lien holder?

by Irais Gutierrez
(California)

I had a car accident where I was the victim of a guy that passed a red light.

My car was claimed a total loss. My question is, after the car is a total loss, do I have to continue making payments to my lien holder?

Will the other parties insurance pay them directly after they send me a check?

Answer:

Hello Irais,

Yes, you have to continue making payments until the loan is totally paid. When you settle to total loss, the lien holder will get paid first, if there is money left, then you get the remainder. If there is no money left (the amount owed in the car is below the fair market value), then you will have to continue to make payments.
