Should his auto insurance cover damages?
My friend son (joey) has liability insurance. the other day he was asked by his friend (mike) to drive mikes car by mike because joey was the only sober one.
However joey had an accident and mike does not have insurance. and joeys insurance is refusing to pay.
and now mike parents are say that they are going to sue joey. can they do that?
Answer:
Well, yeah. Anyone can sue anyone.
Why would mike's parents have standing? How were THEY damaged? Is mike's car not mike's but his parents? Then they may have a recourse.
Joey's insurance will not pay but Joey may have to be responsible for his negligence and causing damage to a vehicle he does not own.
Joey took the keys of the vehicle and with that responsibility for his own actions and damages to the car, if any.
