Rock caused damage to oil pan
by Izzi
(Bellevue, NE)
I was picking my sister up from her apartment when I ran over a rock that I didn't see due to the fact that it was really dark.
I know for sure that the rock put a big hole in my oil pan, but I don;t know what other damages were caused. Since the rock was in the Apartment parking lot, are they responsible for the cost to get my car fixed?
Answer:
Hello Izzi,
It is unlikely that the apartment complex will pay for your damages. Rocks on the road are "road hazards" which are hazards that drivers assume when they drive.
You will have a proof issue also. How do you know it was a rock from the parking lot and not a rock from the public drive way outside the parking lot.
Double check with a local attorney.
Good Luck
