Rear Ended Without Insurace

I was at a stoplight when a van rear-ended us and another car next to us. The van tried to flee the scene but we gave chase getting the license plate number and following the individual to his home all while dialing 911.
The police came on the scene and traced the license plate to the person address. The father claimed he was not driving the car but his son was. Being I was unable to identify who was driving they did not take anyone to jail for hit and run, however the father said he had insurance and that he would cover all damages.
My girlfriend, my 3 year old son, my 18yr daughter and myself were in the car. My question is that my girlfriend does not have insurance on her car. Does that stop us from going after the party who hit us.
We all had minor injuries. We went to the doctor to get checked out.

California does have the "don't pay, don’t play rule." That means that not having insurance could leave you without compensation.
Do talk to an attorney, it is possible that the passengers may have compensation.
