Not at fault for the accident but other car insurance will only pay 60 % liability

Was in an accident where I was going through a green light and another car made a left turn in front of me and I could not stop in time.

The officer at the scene issued her a ticket and she has a court date. in the full police report she was clearly at fault but the officer just stated that she did make a left turn in front of me but did not put that the light was green, her insurance company only wants to pay 60% liability.

The car is not is in my mothers name. I hired an attorney for my personal injuries. how do we get the adjustor to pay for everything for the car and not just 60%?
