Hello Katherine,

Well, the PIP carrier has duty to figure out if there is or there isn't coverage. They can "hold on" to the payments until this occurs. The insured is indeed obligated to cooperate, please see duty to cooperate.

Although this leaves you in a bad position as you rendered the services, you could file a medical lien against the policy for the amount owed (make sure it is proper). The insurance company will have to pay it when it determines coverage (eventually).

If this cannot occur, then you may want to either have the health insurance billed or tell the client that this will go to collection. Explain that the insurance company is not proving coverage. Usually, this get people to actually call their carrier and then give them the statement (recorded or verbal).
