Hit and Run and Coverage
Last night we were in a Hit and Run accident. We were switching to the left lane because of a very slow driver we were behind, about 5 seconds after we switched lanes we got hit really hard in the rear and switched to the right lane again to proceed to pull over.
Thinking the car that hit us was behind us, we look back and they are gone. He hit us while we were moving probably at about 45 mph or so, while he hit us at full speed.
Me and the driver are both suffering from neck and back pain the next day.
We did not get the plate numbers ( it was 11:00 at night ), no witnesses even stopped for us and we called the police and filed a report.
I have AAA basic insurance, and would like to know if my claim will be handled by my insurance. Do I get screwed here and have to pay my deductible, when it wasn't my fault?

Hello,
Most of the time, each policy does have an underinsured motorist coverage. Some policies will make it less if you know the identity of the person that hit you or at least there is a police report.
If there is none of that, your deductible will be slightly higher.
If you don't have underinsured / uninsured motorist coverage, then you will have your collision coverage / deductible and it is unlikely that you will have any coverage for pain and suffering.
It is a good idea to talk to an attorney.
