Does a claim expire?

A friend of my crashed my uninsured truck into a lady’s car and the accident was reported and there was a claim. The friend went to jail later for a previous crime for 6 months and I’m getting charged for the damage done to the lady’s vehicle and I wasn’t even there. The truck was in my name. It has been 5 months now since the accident and I haven’t been able to pay for the damage because of the lady’s work schedule.

She has been considerate enough to not sue me but she rarely will answer her phone to fix her car.

After a certain amount of days or months can the claim expire and I not be responsible for the damage done to her vehicle? and her now be responsible for it now. I’ve tried my best I just don’t want her to turn around and sue me if i refuse.

Hello Ryan,

Claims don’t expire, but the statute of limitation does. It can take anywhere from 2 to 6 years, depending on your state law (you will have to look that up) or call a local attorney).

If the statute runs, then she will be unable to bring a claim.
