Me and my two yr old son were hurt. My 2007 Mazda cx7 is totaled she got the ticket right away. who is at fault?
She was flying threw a yield sign a block from our house. I know my road I drive it lots of times and walk it. I hit her side as she came out of nowhere. She got the ticket before me and my two yr old son left in ambulance.
I have a bad head injury chipped kneecap and a couple other problems. My son is mentally traumatized.
He will not get in a car or does he want us in one. He has nightmares and he makes his matchbox cars crash. her insurance company is trying to say it could be some of my fault?

I am sorry to hear about your accident. Well, we are trouble by the statement "she came out of no where." Vehicles do not come out of no where, they come from somewhere. When you make this kind of statement, insurance companies will deduct that you were not paying attention, thereby, putting fault on your shoulders.
Depending on all facts and circumstances, it is very possible that you are somewhat at fault (this is particularly true if you got a ticket, even if you got one after she was already cited).
