Can a car be towed anywhere legally without the driver's knowledge and then be charged for storage?
by Katrina
(Columbus, GA)
My son was in an accident and while he was handling the police information, a tow truck shows up and takes his car to a collision shop without his permission and now wants storage cost before we can even get the car.
We had collision coverage therefore, the insurance will not pay to have the car fixed. But now, we would have to pay for the towing and $20 per day storage. The air bags are still in place.
Answer:
Hello Katrina,
Why would the insurance company not pay? The storage, towing, and expenses are "new" damages that are out of this accident. I don't think they can decline payment like that.
The permission issue could be a defense, however, vehicles are taken to towing all the time where storage is still owed. Talk to a an attorney.
Good Luck,
