Apartment Complex / Icy Road hit
by Carol
(Atlanta, GA)
I was turning into my parking space and slid to the right hitting another car. My insurance is to take car of the other car only.
Can I get something from the apartment complex for their lack of not salting the area?
Answer:
It unlikely. The driver has the duty to proceed with care for the road conditions. If it was icy, then the driver should have anticipated that and go slower. I know this is unfair, but it is how duties are usually attributed.
Also, how much salt was needed? The fact that they salted or plowed etc. may or may not have avoided the accident. It is a question of causation.
You can make the argument that it was their duty to maintain the parking lot, but it will be a difficult thing to argue.
Good Luck
