You can always hire an attorney to protect your interest
You always preserve the rights of counsel. This means that you are always entitled to hire an attorney to protect your interest.
When your insurance company is defending you, and they hire an attorney to protect you, you can hire another attorney to make sure your interests are fully protected.
If you find yourself in court defending a lawsuit, the insurance company will provide for your defense, however they will select the attorney.
This makes many people uncomfortable because if the insurance company is paying for the attorney, who really is their client?
When people are wary on this type of situation, they decide to hire separate counsel and have the two attorneys provide a defense.
You must remember that the attorney, although selected and paid by the carrier, works for you.
This means that their primary duty is to you, and they are required to put your interest first before that of the insurance carrier.
However, you and I know that if the insurance company is paying for the defense, they have a lot of control over the attorney!
Be aware of this situation. There are too many conflicts of interests.
